01Acceptance of terms
By creating a PodRandom account or accessing the service at podrandom.com (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
02Eligibility
You must be at least 13 years old to create an account. By signing up, you represent that you are 13 or older and that you have authority to enter into this agreement.
03Account responsibilities
- You are responsible for maintaining the security of your password.
- You may not impersonate another person or misrepresent your identity.
- One human, one account.
04Recording and consent
PodRandom enables either participant in a conversation to record locally to their device. By starting any session, you affirmatively consent to the possibility of being recorded by another participant. A visible “REC” indicator is shown when recording is active. Use of the Service constitutes consent under applicable wiretap laws in two-party-consent jurisdictions.
Recordings are stored locally on the recording user's device. PodRandom does not host, retain, or moderate recordings unless they are reported via the in-product Report flow.
05Acceptable use
You agree not to use the Service to:
- Solicit, share, or display sexual content involving minors
- Display nudity, sexual content, or sexually suggestive behavior of any kind, regardless of participant age
- Engage in harassment, threats, or hate speech
- Distribute malware or attempt to gain unauthorized access to systems
- Spam, advertise, or commercially promote without permission
- Infringe the intellectual-property rights of others (see DMCA section below for the takedown process)
- Engage in any activity that violates applicable law
06Moderation and bans
We use community reports and automated thresholds to suspend accounts. Repeat violators may be permanently banned. We may also suspend any account at our discretion if it threatens the safety or integrity of the Service.
07Subscriptions and payments
Pro subscriptions, when available, are billed monthly via our payment processor. Subscriptions auto-renew until cancelled. Refunds are provided per applicable law.
08Disclaimers
The Service is provided “as is” without warranty. PodRandom is not responsible for the content of conversations between users. Users speak with strangers at their own risk.
09Limitation of liability
To the maximum extent permitted by law, PodRandom and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
10DMCA / copyright
PodRandom respects intellectual-property rights and complies with the U.S. Digital Millennium Copyright Act (17 U.S.C. §512). If you believe content on the Service infringes your copyright, send a written notice containing all of the following to the email address below:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed
- Identification of the material claimed to be infringing, with enough detail for us to locate it (URL where possible)
- Your contact information (address, phone, email)
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner's behalf
Send notices to dmca@podrandom.com. We will remove or disable access to material that is the subject of a complete and good-faith notice. We terminate the accounts of repeat infringers under the policy described below.
Repeat-infringer policy. An account that is the subject of two or more good-faith DMCA notices in a rolling 12-month period will be permanently terminated. Counter- notices follow §512(g): if you believe your content was removed by mistake, you may submit a counter-notice to the same email address.
Note: Recordings are stored locally on each user's device, not on PodRandom servers. We can remove a user's account, profile, and server-side artifacts (avatar, bio, public sessions), but cannot retrieve recordings already saved to a stranger's computer.
11Changes to these terms
We may update these terms; material changes will be announced on this page with an updated “Last updated” date.
12Arbitration and class-action waiver
Please read this section carefully. It limits how you can resolve disputes with PodRandom.
You and PodRandom agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (each a “Dispute”) will be resolved by binding individual arbitration before a single arbitrator under the Consumer Arbitration Rules of the American Arbitration Association (“AAA”), and not in court. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Class-action waiver. You and PodRandom each agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person and may not preside over any form of representative or class proceeding.
Opt-out. You may opt out of this arbitration agreement by emailing legal@podrandom.com within 30 days of first accepting these Terms. Your opt-out notice must include your account email and a clear statement that you opt out of arbitration.
Time to bring a claim. Any claim arising out of or related to these Terms or the Service must be filed within one (1) year after the cause accrues, or it is forever barred.
Small-claims court actions for individual relief that qualify in your jurisdiction's small-claims court are excluded from this arbitration agreement.
13Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any judicial action permitted under the Arbitration section above (e.g. enforcement of an arbitration award) shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
Note: If PodRandom's operating entity is incorporated in a different jurisdiction, replace “State of Delaware, USA” above with that jurisdiction. Default Delaware reflects the most common US-startup incorporation choice and gives users a predictable legal venue. Update once the operating entity is finalized.
